In a trademark dispute over "Pinnacle" vodka, the plaintiff started a first action in the Quebec Superior Court seeking to obtain an injunction against the defendant Beam Inc. In 2013, the present action was started. The defendants moved to stay the Quebec proceeding in favour of the FC action. In the FC action, Prothonotary Morneau denied the plaintiff's request to amended their action to exclude Quebec. Justice Boivin dismissed the appeal with costs.
